Terms & Conditions

MyOpenTalk is operated by EvenQuad LLC (“we,” “us,” or “our”). These Terms apply to your use of www.myopentalk.com as a speaker or listener. Please read them before creating an account or joining a session.

1. Our service

MyOpenTalk converts a speaker’s speech into live text that listeners can view through a shared session link. The service is designed for one speaker and up to ten active listeners per session.

Speakers must create an account. Listeners can join through a shared link without registering. Usage allowances, session limits, prices, and available features are displayed in the service.

2. Your account

You must provide accurate registration information and use an email address you are authorized to use. Keep your password secure and notify us at support@evenquad.com if you suspect unauthorized access.

If you use MyOpenTalk for an organization, you confirm that you are authorized to act on its behalf.

You must have the legal capacity to agree to these Terms. Where parental or guardian permission is required, you must obtain it before using the service.

3. Permission to transcribe

Before starting a session, the speaker must inform anyone whose speech may be captured that it will be processed into text and shared with listeners. The speaker must obtain any consent or other permission required by applicable law.

Do not transcribe or share conversations, confidential information, or other content unless you have the right to do so. Being allowed to hear a conversation does not necessarily give you permission to transcribe or distribute it.

4. Session links and listener responsibilities

Anyone who obtains a session link may be able to view its transcript. Share links only with intended listeners and do not publish links to private sessions.

The listener limit is a service capacity feature, not a guarantee of confidentiality. Listeners may be able to copy, photograph, or retain text they can view.

Listeners must not access sessions without authorization or copy, disclose, or redistribute their content without the necessary permission.

5. Transcript accuracy

Transcripts are generated automatically and may contain errors, omissions, delays, or inaccurate interpretations. Speakers and listeners should verify important information with the original speaker.

MyOpenTalk is not a certified transcription service or an emergency communication service. Its transcripts should not be the sole basis for medical, legal, financial, or safety-critical decisions.

6. Content and processing

We do not claim ownership of your speech or transcripts. You retain any rights you hold in the content you provide.

You authorize us and the service providers we use to process and transmit that content as necessary to provide the transcription service and display it to listeners accessing your session.

Our Privacy Notice explains our handling of personal information, including audio and transcripts, service providers, retention, and applicable privacy rights.

7. Transcript availability

MyOpenTalk provides temporary access to transcripts and is not a permanent archive. Transcripts are generally available through the service for approximately one hour after a session ends, subject to technical availability.

The end of viewing access does not mean that every copy has been immediately deleted. Database cleanup, service-provider retention, and backups are addressed in our Privacy Notice. We cannot delete copies independently retained by listeners.

8. Acceptable use

You must not:

  • Use the service unlawfully or infringe another person’s privacy, intellectual property, or other rights.
  • Conduct unauthorized surveillance, impersonate others, or use the service to harass or threaten anyone.
  • Access accounts or sessions without authorization.
  • Bypass usage limits, interfere with security controls, or disrupt the service.
  • Upload malicious content or attempt to compromise our systems.

9. Free and paid plans

Free plans are subject to the usage limits displayed in the service.

Paid subscriptions bill monthly at the price shown for the selected plan. Before you confirm payment, the checkout page will display the price, currency, that billing is monthly and automatically renewing, applicable taxes, and how to cancel. Payments are processed through Stripe.

Paid subscriptions renew automatically at the disclosed billing interval until cancelled. We will disclose any price changes before they take effect and obtain further consent where required by law.

10. Cancellation and refunds

You can request cancellation through Account & Plans → Cancel Subscription.

Under our standard refund policy, cancellation within 24 hours of a successful subscription payment qualifies for a refund of that payment and immediate termination of paid access.

After that period, cancellation takes effect at the end of the current paid billing period. Paid access continues until then, and no partial-period refund is provided except where required by law.

Refunds are returned through the payment processor to the original payment method where possible. Your bank or payment provider determines when the refund appears.

If you experience a cancellation or billing problem, contact support@evenquad.com. Nothing in this policy limits mandatory consumer rights.

11. Account deletion

You may request account deletion through your account settings or by contacting support@evenquad.com.

If you have an active paid subscription, you must cancel it before your account can be deleted. Cancel it first through Account & Plans → Cancel Subscription, then request deletion. If your cancellation is already scheduled for the end of the current billing period, account deletion becomes available once that period ends, since the paid access for it has already been paid for. If you cannot cancel, contact us for assistance before proceeding.

Some information may need to be retained for legal, accounting, fraud-prevention, or dispute-resolution purposes, as explained in our Privacy Notice.

12. Availability and suspension

We aim to keep MyOpenTalk available, but access may be interrupted by maintenance, technical failures, network conditions, or service-provider outages.

We may restrict or suspend access when reasonably necessary to address security threats, misuse, material breaches of these Terms, or legal obligations. Where practical and appropriate, we will provide notice and an opportunity to resolve the issue.

Suspension or closure does not remove any refund or other rights you have under applicable law.

13. Responsibility and limitations

To the extent permitted by law, the service is provided on an “as available” basis without guarantees of uninterrupted operation or complete transcription accuracy.

To the extent permitted by law, we are not liable for indirect or consequential losses resulting from use of the service.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limits your mandatory consumer or privacy rights.

14. Changes to these Terms

We may update these Terms to reflect changes to the service or legal requirements. We will update the effective date and provide reasonable notice of material changes. Where required, we will obtain your agreement before those changes apply.
